Binance Faces Renewed US Scrutiny Over Alleged Iran Sanctions Violations
Binance, the world’s largest cryptocurrency exchange, finds itself once again under intense regulatory pressure from United States authorities.
A recent Bloomberg report on September 22 revealed that federal prosecutors in the U.S. are investigating whether Binance may have violated American sanctions by allegedly failing to prevent certain transactions linked to Iran. Sources familiar with the matter indicate that the investigation is being spearheaded by the U.S. Attorney’s Office for the Southern District of New York in Manhattan, with involvement from the Criminal Division of the Department of Justice (DOJ) in Washington. Prosecutors are reportedly examining whether Binance “knowingly” permitted these transactions to proceed despite being aware of their nature.
It is crucial to emphasize that this inquiry is currently in its investigative phase. It does not signify that Binance has been found guilty of any violations or is facing new criminal charges. The DOJ reportedly declined to comment on the Bloomberg report, while Binance reiterated its “zero-tolerance” policy against sanctions violations. The exchange affirmed its commitment to full cooperation with law enforcement agencies, continuously working to identify and block malicious actors from utilizing its platform.
The Core of the Investigation: “Knowing” Violations
According to Bloomberg’s insights, the central focus of the current prosecutorial probe extends beyond merely the presence of Iran-related transactions on Binance’s platform. The more critical question revolves around subjective knowledge: Did Binance possess awareness that specific transactions might involve sanctioned Iranian users or entities, yet still allow them to occur?
This distinction is paramount in legal contexts. Large global exchanges, by their very nature, cannot guarantee that all illicit funds will be entirely prevented from entering their platforms. Consequently, criminal liability often hinges on whether a company has implemented reasonable compliance measures and how it responds to identified risks.
The Bloomberg report has not yet disclosed specific details regarding the transaction accounts, amounts, or timelines under investigation, nor has it indicated whether any charges have been formally decided upon.
Preceding Civil Forfeiture Case Against Iranian Oil Sales
This new investigation emerges just one week after the U.S. Department of Justice announced a separate Iran-related case involving Binance accounts. On September 14, the U.S. Attorney’s Office for the Southern District of New York unveiled a civil forfeiture lawsuit aiming to seize approximately $61 million in cryptocurrency. Prosecutors allege these assets were derived from the black market sale of sanctioned Iranian oil.
The DOJ accused Chinese companies Blessed Trust and Hexa Whale of using Binance trading accounts, reportedly based in the UAE, to process these funds. The proceeds from Iranian oil sales were allegedly channeled towards the Iranian government, its proxies, or associated organizations, with the network of wallets purportedly handling over $1.5 billion in total funds.
It’s important to note that the September 14 case was a civil forfeiture action targeting assets, not a criminal prosecution directly against Binance. The DOJ itself highlighted in its announcement that the allegations within a civil forfeiture complaint are government claims that have not been proven in court. The Financial Times also reported that this forfeiture case did not accuse Binance of any wrongdoing. Binance, for its part, stated that it took action on the relevant accounts upon discovering the issues.
Binance’s Firm Stance: “Zero Tolerance”
Binance’s position regarding the latest reports remains unequivocal. As communicated to Reuters, Binance maintains a “zero-tolerance” policy towards sanctions violations. The exchange emphasized its full cooperation with law enforcement to continuously identify and prevent illicit actors from exploiting its platform.
Legally, the mere presence of illicit funds on an exchange differs significantly from an exchange “knowingly permitting” such transactions. The ongoing U.S. prosecutorial investigation is reportedly focused on determining whether the latter scenario applies.
Market Reaction: BNB Remains Resilient
Despite the unfolding news of the investigation, the market reaction has been relatively subdued for Binance Coin (BNB). According to market data from September 22, BNB was trading at approximately $789.4, showing a 24-hour increase of 1.65%, with intraday highs around $806.53 and lows near $766.96. Earlier CoinGecko quotes even showed BNB at approximately $806, reflecting a 24-hour gain of about 5%, with a market capitalization of roughly $107.3 billion, and 24-hour trading volume close to $1.9 billion.
